Chani Dhaliwal

Chani leads and manages a serious injury team in the London office of Irwin Mitchell LLP. He specialises in complex serious injury cases representing clients with brain injury, spinal cord injury, amputation, and complex orthopaedic injuries.

He also deals with high profile fatal claims and has a specialist interest in insurance indemnity and MIB issues.

He has built a reputation of handling difficult cases and getting results. He is passionate about helping their clients get the best rehabilitation after suffering life changing injuries. He has expertise in securing substantial interim payments for the purpose of providing rehabilitation, private care packages and accommodation.

Cases of interest include:

  • Successfully representing a brain injured claimant in a complex case which proceeded to 8-day liability and causation trial at the Royal Courts of Justice. The trial concerned the catastrophic brain injuries suffered by the claimant during four phases of road traffic collisions, involving two vehicles.  The court was required to determine complex issues of medical and legal causation, in particular in relation to diffuse axonal injury, as well as the issue of the identity of one driver. Farah v Abdullahi & Ors [2020] EWHC 825 (QB)

 

  • Successfully representing a brain injured claimant in a difficult road traffic collision which proceeded to a split trial on liability. The claimant had stepped from a central pedestrian island on Aldwych, London, at which point she was struck by a taxi and suffered a severe brain injury. The Court found that the CCTV footage was inconsistent with the defendant’s evidence and concluded that the driver could and should have seen the claimant before she stepped into the road and anticipated her doing so. Had he done so he would have avoided the collision. Podesta v Akhtar & Aviva Insurance Limited [2018] EWHC 1245

 

  • Securing a settlement of £15.3m for a client who suffered a very severe brain injury as a result of a road traffic collision. The settlement provided provision for a 24/7 support package.

 

  • £10.4m compensation for a client who suffered a catastrophic brain injury due to an accident at work

 

  • £1.82m compensation and ongoing £55,000 annual payments for a client who needs life-long care after a severe brain injury

 

  • £2.7m compensation for a client who had to have a leg amputation after being hit by a car

 

  • Representing a spinal cord injured claimant which was the first case to have secured a significant interim payment to fund the purchase of a ReWalk Exoskeleton, opening the doors for other claimants to secure funding for this innovative technology.

 

  • Represented the wife and daughter of the man who died in the Crossrail fatality.
