(Alternative) Dispute Resolution for Personal Injury Lawyers

APIL Senior Fellows Paul Balen and Frances McCarthy, Directors of Trust Mediation Ltd review and explain the different options for out of court dispute resolution.

What will you be gaining from this session?

  • Understanding of the current landscape for ADR; recent case law such as the Churchill and Manchester City cases; changes to the CPR and Pre-action Protocols; options available such as mediation and evaluation, and the risks faced if you do not embrace ADR.
     
  • Confidence to have the ADR discussion with your client: what should they expect from the each ADR process; what are the potential outcomes; and to debate with your opponent (and if necessary the case management judge) the option you consider best for your client.
