Fatal claims and the victims of crime

This webinar looks at the remedies available when someone has died as a result of a violent act. What steps can be taken by the dependants and the estate to obtain damages?

It looks at the Criminal Injuries Compensation Scheme in detail including:

  • Why practitioners need to be aware of the scheme
  • The limitation periods
  • How the scheme works
  • Those eligible to make a claim
  • The bereavement damages award
  • Loss of dependency claims
  • Calculation of loss of dependency
  • Loss of a parents’ services
  • When a second award can be made
  • When a victim dies before the award but not as a result of the criminal act

There is a comprehensive review of the case law in which the fatal claims under the CICA have been considered in the courts.

It then looks at the options for bringing a civil claim:

  • Is there a party worth suing?
  • How can a claim be brought
  • Particular issues in claims arising from victims of crime
  • The overlap between a CICA claim and a civil claim – the possibility of having to repay the CICA.
