The QOCS regime was brought into effect in April 2013 as part of the Jackson reforms. The regime was subject to intense scrutiny in the appeal courts and the outcome was very favourable to claimants and their solicitors. Too favourable? Yes, said the Government, so the rules were changed for cases issued after April 2023.
This webinar will give guidance on dealing with the run-off of cases subject to the old QOCS regime, cases subject to the new QOCS regime and the increased appetite for defendants seeking costs orders against firms of solicitors.
Tom will cover:
- Why was QOCS introduced?
- How did the courts interpret the old QOCS rules?
- Why were the old QOCS rules considered unfair?
- How was the unfairness addressed?
- What was changed for the new QOCS rules?
- What does this mean going forward?
- Will defendants seek costs against firms of solicitors instead?
- How are defendants going to do this?
- What's the difference between non-party costs orders and wasted costs orders?
