APIL CPD:
All levels - 1 hour

(Please note that the number of CPD hours may be subject to change)

Schedules, and particularly counter schedules, have become a key battle ground in personal injury litigation, even though the Civil Procedure Rules have very little to say about form, content and purpose.

Consequently, personal injury practitioners need to understand practical and tactical considerations for claimant when preparing a schedule and the corresponding tactical considerations defendants are likely to have in mind in relation to counter schedules.

This session will cover:

  • Why do we have schedules at all?
  • What are the relevant provisions relating to schedules and counter schedules in the Civil Procedure Rules?
  • Provisional or final schedule?
  • Without prejudice or open schedule?
  • Do’s and Dont’s for the schedule
  • When should the defendant provide a counter schedule?
  • What are current defendant tactics with schedules?
  • Are there any counter tactics for claimants?
  • Advising the claimant
  • Preparing for trial
  • Tackling the counter schedule
