This webinar will review the important concept of vulnerability and how this may be relevant throughout any claim where a party or witness may be vulnerable including:

  • The definition of vulnerability in the CPR
     
  • The general approach of the Courts

  • Dealing with vulnerability of the claimant (and defendant) at the outset
     
  • Dealing with vulnerability in the claim form, directions questionnaire, listing questionnaire and application notices
     
  • The need for ground rules ahead of trial
     
  • The pervasive nature of vulnerability (as part of the overriding objective)
     
  • Vulnerability and proportionality in non-fixed cost cases
     
  • The problem of vulnerability in fixed costs cases
